โปรดศึกษารายละเอียดต่อไปนี้ ซึ่งเป็นข้อกำหนดและเงื่อนไขการใช้บริการ (“แอปพลิเคชั่น” หรือ “ระบบ”) ระหว่าง บริษัท โกลบเทค จำกัด (“บริษัท” “เรา” หรือ “NOSTRA MAP”) กับ ผู้ใช้งาน (“คุณ”) กรุณาอ่านข้อกำหนดเงื่อนไขการให้บริการโดยครบถ้วนเพื่อผลประโยชน์ของตัวผู้ใช้งาน

ข้อกำหนดและเงื่อนไขการใช้บริการ

คุณยอมรับและตกลงว่า คุณจะใช้บริการ NOSTRA MAP ตามวัตถุประสงค์ที่กำหนดไว้อย่างถูกต้อง เป็นไปตามเงื่อนไขและกฎหมาย หรือในลักษณะที่เหมาะสม ชอบธรรม และไม่ได้เป็นการจำกัดเพียงเท่านี้ คุณตกลงว่าเมื่อคุณใช้บริการ NOSTRA MAP คุณจะ:

• คุณอาจจำเป็นที่จะต้องลงทะเบียนเป็นสมาชิกเพื่อจะใช้บริการของเราได้อย่างเต็มประสิทธิภาพ โดยคุณเข้าใจและยอมรับว่าทางเราสงวนสิทธิ์ที่จะปฏิเสธการลงทะเบียนของคุณและอาจยกเลิกการลงทะเบียนของสมาชิกของคุณได้ทุกเวลา โดยเฉพาะเมื่อเกิดการละเมิดกฎระเบียบหลักเกณฑ์ข้อตกลงในการใช้งาน คุณไม่สามารถซื้อขาย แลกเปลี่ยน หรือโอนบัญชีสมาชิกไปยังบุคคลอื่นได้ หากละเมิดเงื่อนไขคุณยอมรับว่าบัญชีจะถูกยกเลิกทันที

• คุณต้องไม่ส่งหรือเขียนข้อความที่หยาบคาย ลามก อนาจาร หมิ่นประมาท ส่อเสียด คุกคาม ว่ากล่าวให้ร้าย ขู่กรรโชก แก่บุคคลอื่น รวมทั้งข้อความอื่น ๆ ที่ขัดต่อข้อกฎหมาย

• คุณตกลงว่าจะไม่ (และไม่อนุญาตให้บุคคลที่สาม) แก้ไขดัดแปลง แปลหรือย้อนกระบวนการผลิต (reverse engineer) ส่วนของเว็บไซต์ กรอบของเว็บไซต์ หรือลอกเลียนแบบส่วนของบริการใด ๆ จากเว็บไซต์ รวมทั้งลอกลิขสิทธิ์เครื่องหมายการค้า หรือข้อมูลทรัพย์สินทางปัญญาอื่น ๆ เพื่อวัตถุประสงค์ใด ๆ ก็ตาม ยกเว้นจะได้รับการอนุญาตเป็นลายลักษณ์อักษรจากทางบริษัท

• คุณจะไม่ทำการส่งไวรัส เวิร์ม โทรจันฮอร์ส หรือสิ่งแปลกปลอมอื่นใด ที่มีลักษณะเป็นการทำลายการให้บริการของเรา

• คุณจะไม่แทรกแซงหรือรบกวนบริการของเรา หรือ เซิร์ฟเวอร์ หรือ เครือข่ายใด ๆ ที่เชื่อมต่อกับบริการของเรา หรือฝ่าฝืนขั้นตอนการปฏิบัติ ข้อกำหนด นโยบาย หรือระเบียบของเครือข่ายใด ๆ ที่เชื่อมต่อกับบริการของเรา

• คุณจะไม่ใช้วิธีการหรืออุปกรณ์ใด ๆ เช่น โรบ็อต สไปเดอร์ หรือแอปพลิเคชั่นในการสืบค้น/ดึงข้อมูล หรือจัดทำดัชนีส่วนใด ๆ ของบริการของเรา หรือเก็บรวบรวมข้อมูลเกี่ยวกับผู้ใช้เพื่อวัตถุประสงค์ที่ไม่ได้รับอนุญาตจากทางบริษัท

• แผนที่ NOSTRA อาจมีความไม่เที่ยงตรงถูกต้องในทางเทคนิค อาจมีการพิมพ์ สะกดผิด หรือข้อผิดพลาดใด ๆ และแอปพลิเคชั่นหรือแผนที่ NOSTRA อาจมีเนื้อหาที่ล่วงต่อสิทธิส่วนบุคคล หรือ สาธารณะ หรือ อาจเป็นของ หรือ สิทธิของบุคคลอื่น เราไม่ขอรับผิดใด ๆ ในความเสียหาย สูญเสีย สูญหาย และ ผลใด ๆ ที่ตามมาอันเป็นผลจากการใช้งานแอปพลิเคชั่น หรือ การใช้แผนที่ NOSTRA หรือจากการดาว์นโหลด คัดลอก จัดพิมพ์ ดู หรือ รับฟังใด ๆ โดยผู้ใช้เนื้อหาข้อมูลใด ๆ ของแอปพลิเคชั่นนี้ หรือแผนที่ NOSTRA

• ในส่วนการบริการของเราบนอุปกรณ์โทรศัพท์มือถือ ทางบริษัทไม่สนับสนุนให้คุณใช้งานหรือป้อนข้อมูลใน NOSTRA MAP ในขณะขับขี่หรือควบคุมยานพาหนะ เพื่อความปลอดภัยในการใช้งานคุณยอมรับและตกลงว่าคุณจะใช้งานเพื่อวางแผนเส้นทางก่อนเริ่มการเดินทาง และปฏิบัติตามกฎหมายจราจรอย่างเคร่งครัด

• สำหรับบริการของเราที่อนุญาตให้คุณอัพโหลดข้อมูลเนื้อหาหรือรูปภาพมาจัดเก็บได้ คุณยังคงความเป็นเจ้าของสิทธิ์ในทรัพย์สินทางปัญญาใด ๆ สำหรับข้อมูลนั้น ๆ และเมื่อคุณอัพโหลดข้อมูลมาจัดเก็บบนระบบของเรา คุณยอมรับและได้อนุญาตให้เรามีสิทธิ์ในข้อมูลของคุณ ในการใช้ จัดเก็บ ทำซ้ำ แก้ไข ดัดแปลง เผยแพร่ และแบ่งปันข้อมูลดังกล่าว สิทธิ์ที่คุณให้จะเป็นไปเพื่อการพัฒนาและปรับปรุงแอปพลิเคชั่นและบริการของเราให้ตอบสนองการใช้งานที่ดียิ่งขึ้น สิทธิ์นี้จะยังคงมีผลแม้ว่าคุณจะหยุดการใช้บริการของเราแล้วก็ตาม

• เรามีการปรับปรุงและพัฒนาแอปพลิเคชั่นของเราอย่างสม่ำเสมอ เราอาจเพิ่ม ลด หรือปรับเปลี่ยนการทำงาน ฟังก์ชั่น รูปลักษณ์ หรือคุณลักษณะบางอย่างภายในแอปพลิเคชั่นหรือแผนที่ NOSTRA และเราอาจระงับ หรือหยุดให้บริการใดบริการหนึ่งเป็นการชั่วคราวหรือเป็นการถาวรได้ทุกเมื่อโดยไม่ต้องแจ้งให้ทราบล่วงหน้า

• เพื่อประสบการณ์การใช้งานที่ดีที่สุดคุณยอมรับและตกลงที่จะใช้งานแอปพลิเคชั่นเวอร์ชั่นล่าสุดที่เราเปิดให้บริการ และสำหรับการใช้บริการของเราบนอุปกรณ์โทรศัพท์มือถือ คุณยอมรับและตกลงที่จะอัพเดทเวอร์ชั่นของแอปพลิเคชั่นให้เป็นเวอร์ชั่นล่าสุดอยู่เสมอ ทั้งนี้แอปพลิเคชั่นเวอร์ชั่นที่สูงขึ้นในอนาคตอาจจะไม่รองรับการทำงานบนอุปกรณ์หรือระบบปฏิบัติการบางรุ่นที่รองรับอยู่ในเวอร์ชั่นปัจจุบัน

นโยบายความเป็นส่วนตัว (Privacy Policy)

เพื่อให้คุณได้รับบริการที่ดีที่สุด เรามีการเก็บรวบรวมข้อมูลและมีนโยบายการบริหารและใช้ข้อมูลดังนี้

• ข้อมูลที่เก็บรวบรวมและใช้งานโดย NOSTRA MAP

• เราอาจจะมีการแสดงโฆษณาของบุคคลที่สามในแอปพลิเคชั่น เราสงวนสิทธิ์ในการใช้ข้อมูลส่วนตัวของคุณเพื่อแสดงโฆษณาที่เป็นประโยชน์กับคุณมากที่สุด ในบางกรณีเราอาจจะติดต่อคุณทางอีเมล์ในนามของบุคคลที่สามเพื่อวัตถุประสงค์ทางการตลาดโดยตรงได้

• เราอาจเปิดเผยข้อมูลของคุณให้แก่ บริษัทในเครือ บริษัทคู่ค้า ธุรกิจหรือบุคคลอื่น ๆ ที่วางใจได้ โดยดำเนินการตามมาตรการรักษาความปลอดภัยของข้อมูลที่เหมาะสม

การจำกัดความรับผิดทางกฎหมาย

• บริษัทไม่รับรองใด ๆ ในข้อมูลที่ปรากฏใน แอปพลิเคชั่น หรือ แผนที่ NOSTRA เราไม่ให้คำรับรอง หรือยืนยันในความเที่ยงตรงถูกต้องของข้อมูลในแอปพลิเคชั่น หรือแผนที่ NOSTRA เราไม่ขอรับผิดชอบในการใช้หรือผลใด ๆ อันเกิดจากการใช้ข้อมูล เนื้อหา ในแอปพลิเคชั่น หรือแผนที่ NOSTRA คำที่กล่าวไว้แล้วข้างต้น นอกจากนี้ เราไม่ขอรับรองว่า ก) ข้อมูลใด ๆ ใน แอปพลิเคชั่น หรือแผนที่ NOSTRA นี้จะปรากฏอยู่เสมอตลอดเวลา หรือปรากฏอยู่ทั้งหมด ข) ข้อมูลใด ๆ ใน แอปพลิเคชั่น หรือแผนที่ NOSTRA จะครบถ้วนเป็นจริงถูกต้อง เป็นปัจจุบัน ไม่มีข้อผิดพลาด ตกหล่น หรือเชื่อถือได้เสมอ

เพียงเท่าที่จะสามารถละเว้นได้ตามกฎหมาย เราขอไม่รับผิดชอบใด ๆ และไม่รับรองใด ๆ อย่างชัดเจนหรือโดยปริยายจากความพึงพอใจในคุณภาพ การที่เอาไปใช้ การซื้อขายในเชิงพาณิชย์ ความเหมาะสมในวัตถุประสงค์ของสินค้า ความสมบูรณ์และความใส่ใจในขั้นตอนการผลิต และการปราศจากการละเมิดสิทธิ์

• ทางบริษัทจะไม่รับผิดชอบในความเสียหายใด ๆ รวมถึงความสูญเสีย การบาดเจ็บ การสูญเสียผลกำไร รายได้ ยอดขาดทุนทางการเงิน และค่าใช้จ่ายที่เกิดขึ้นทั้งโดยตรงและโดยอ้อม โดยบังเอิญ หรือเป็นผลสืบเนื่องที่ตามมาจากการใช้งาน NOSTRA MAP ทุกกรณี

• ทางบริษัทจะไม่รับผิดชอบความเสียหาย หรือข้อมูลใด ๆ ที่ปรากฏอยู่บนเว็บไซต์อื่น ๆ ที่เกิดจากการแชร์โลเคชั่นจาก NOSTRA MAP ใด ๆ ทั้งสิ้น ไม่ว่าจะเป็นความเสียหายทางตรง หรือทางอ้อม

การรักษาความปลอดภัย

เราตระหนักดีว่าความเชื่อถือของคุณเป็นสิ่งสำคัญในการบริการของเรา เราจึงพัฒนาระบบและให้บริการตามมาตรฐานสากลซึ่งเป็นที่ยอมรับโดยทั่วไปในการป้องกันข้อมูลส่วนตัวของคุณ ทั้งในระหว่างการส่งและหลังจากที่เราได้รับข้อมูลดังกล่าว อย่างไรก็ตามโปรดตระหนักว่าไม่มีวิธีการส่งข้อมูลผ่านทางอินเทอร์เน็ตหรือวิธีการเก็บข้อมูลอิเล็กทรอนิกส์วิธีใดที่ปลอดภัย 100% ดังนั้นเราจึงไม่สามารถจะรับประกันความสมบูรณ์ของการรักษาความปลอดภัยได้ และทางบริษัทขอสงวนสิทธิ์ในการปฏิเสธความรับผิดชอบในกรณีที่ข้อมูลสูญหายหรือถูกขโมย หรือถูกดักจับระหว่างทาง ไม่ว่ากรณีใด ๆ ทั้งสิ้น

การแก้ไขข้อกำหนดการใช้บริการ

ทางบริษัทขอสงวนสิทธิ์ที่จะแก้ไขข้อกำหนดการใช้บริการโดยไม่ต้องแจ้งให้ทราบล่วงหน้า คุณยอมรับและตกลงว่าคุณสามารถเข้ามาตรวจสอบข้อกำหนดการใช้บริการฉบับล่าสุดได้ที่นี่เสมอ หากมีการเปลี่ยนแปลงเราจะแสดงข้อความแจ้งให้คุณทราบอย่างชัดเจนบนหน้านี้

ข้อกำหนดเรื่องการแสดงสัญลักษณ์ลิขสิทธิ์

สำหรับการใช้งาน NOSTRA MAP ทั้งกรณีใช้งานบนแอปพลิเคชั่นและการแสดงผลบนสื่อสิ่งพิมพ์ คุณยอมรับและตกลงว่าจะแสดงสัญลักษณ์ลิขสิทธิ์ NOSTRA ให้เป็นที่ประจักษ์ต่อผู้ใช้งานซึ่งเป็นบุคคลทั่วไปว่าแอปพลิเคชั่นของคุณใช้บริการ NOSTRA MAP และการใช้งานดังกล่าวอยู่ภายใต้ข้อกำหนดสำหรับการใช้บริการนี้ โดยคุณยอมรับข้อกำหนดการแสดงสัญลักษณ์ลิขสิทธิ์ ดังต่อไปนี้ :

• คุณจะทำการดาวน์โหลดไฟล์ ZIP จากลิงค์ด้านล่าง ซึ่งประกอบด้วยไฟล์รูปภาพสัญลักษณ์ลิขสิทธิ์ NOSTRA และรองรับขนาดสำหรับการใช้งานบนเว็บเบราว์เซอร์ แอปพลิเคชั่นแอนดรอยด์ และ แอปพลิเคชั่นไอโอเอส

• สัญลักษณ์ลิขสิทธิ์จะต้องปรากฏอยู่ที่มุมด้านล่างด้านใดด้านหนึ่งบนแผนที่บนเว็บไซต์และ/หรือแอปพลิเคชั่นของคุณในขนาดที่เหมาะสมสามารถอ่านเข้าใจได้ตลอดระยะเวลาในช่วงระหว่างการใช้ส่วนหนึ่งส่วนใดหรือทั้งหมดของบริการ NOSTRA MAP SERVICE

Thank you for choosing NOSTRA MAP (“Services”). The following terms and conditions govern all use of Services (“Application” or “System”) between GlobeTech Co., Ltd. (“GlobeTech”, “we” or NOSTRA MAP”) and User (“you”) (the “Agreement”).

Terms of Services

By using our Services, you acknowledge and agree to comply with this Agreement and all applicable laws or public order and good moral. In addition, you agree that:

• You may need to register as a member to use our full services. You understand and agree that we reserve the right to refuse your registration and may cancel your membership at any time, if you are in breach of this Agreement. You must not trade, exchange, transfer, or assign your account to others. If you are in breach this Agreement, your account will be terminated immediately.

• You must be responsible for taking precaution as necessary to protect yourself or your computer systems from viruses, worms, trojan horses and any other code of a destructive or disruptive nature which may interfere or destroy content of the System.

• You must not use our Service to defame nation, or commit lese majesty and blasphemy.

• You must not send or post any inappropriate word, pornography, defamation, harassment, violence, threat to any third party including any other content which violates the law.

• You agree not to (and not allow a third party to) amend, modify or reverse engineer any part or frame surrounding website or copy any part of Services from website including infringe of Copyright, Trademark or any other intellectual property for any purpose unless you have obtained a written consent from GlobeTech.

• You must not send viruses, worms, trojan horses or any other code of a destructive or disruptive nature which may destroy our Services.

• You must not interfere or interrupt our Service or surfer or any other network which links to our Services nor violate rules, terms, policies or regulations of any network which links to our Services.

• You must not use any means or devices e.g. robot, spider or application to search/pull information or create any part of index of our Services or collect information of users without GlobeTech’s consent.

• NOSTRA MAP may not contain technical inaccuracies or typographical error or any other error. Application or NOSTRA MAP may contain a content violating to a privacy or publicity right or infringe the intellectual property and other proprietary rights, of third parties, we will not be responsible for any loss, damage or consequence resulting from using Application or NOSTRA MAP or from any downloading, copying, publishing, showing or listening by User using this Application or NOSTRA MAP.

• For our Services on a mobile phone, GlobeTech does not encourage you to use or put information to NOSTRA MAP while driving or controlling any vehicle. For your own safety, you accept and agree that you plan a destination prior to traveling and strictly comply with traffic regulations.

• As our Services allow you to upload information, content or picture to store in a file, you retain your right to any content you upload. By uploading content through our System, you accept and grant us the right to use, store, copy, amend, modify, display, and share such your information. The right granted to us is to develop and improve our Application and Services for better service. The right will survive a termination of this Agreement.

• We always develop and improve our Application. We may add, reduce or amend some use, function, appearance or characteristic of Application or NOSTRA MAP; and cease or stop any of Services temporarily or permanently at any time without prior notice.

• For the best use of Services, you accept and agree to use the latest version of Application. For the best use on a mobile phone, you accept and agree to always update the latest version of Application. However, the higher version in the future may be not applicable to use on some device or operating system which is applicable to the current version.

Privacy Policy

For your best benefit, we collect information, have administrative policies and use information as follows:

• Information collected and used by NOSTRA MAP

• We collect your privacy information as necessary, when you log in NOSTRA MAP e.g. name, address, email, gender and date of birth. For easier use, you can log in NOSTRA MAP by using Facebook account. We will use your email address to create an account and locate your location to help Application find your location. We may use email or phone number to contact or send message to you.

• You can use Application in maximum capacity, when you turn on a function to find your current location through GPS on mobile device or web browser. We may collect and evaluate your actual location and use your location for purpose of marketing and locate your address to a third party. If you want to disclose your location, you can turn off this function of finding your current location through mobile device or web browser.

• We collect information relevant to your use through Application automatically when use of our Application e.g. date and time of use, location, information searched or opened by you or model of your device e.g. hardware model, operating system model, web browser type, IP number, and mobile phone network which we use these information for evaluate demand and interest of users to develop and improve our Application and Services for better service.

• Disclosure

• We may advertise a third party’s advertisement on Application. We reserve the right to use your privacy information to display an advertisement which is best for you. In some cases, we may contact you through email behalf of a third party for direct marketing purpose.

• We may disclose your information to our affiliates, alliances, or other reliable entities or persons by complying with security protection rules as appropriate.

• We may disclose your privacy information and your information of Services use, if we honestly believe that such disclosure is necessary for (a) examination of a violation of laws or moral on website, (b) examination of a violation of terms and conditions of our Services, and (c) protection of infringement of intellectual property, violation of right, defamation; and security of GlobeTech and others.

Limitation of Liability

We realize that trustworthiness of Services is important, we therefore develop System and provide our service which is an international standard to protect your privacy information during sending and receiving such information. However, please be aware that there is no 100% sure in sending information via internet or electronically storing information. We cannot guarantee the completion of security. We are not liable for any damage arising out of information lost, stolen or hacked in any cases.

Amendment

We reserve the right to amend terms and conditions of this Agreement without a prior notice. You accept and agree that you will always access to check the most current version of this Agreement. If there is any amendment, we will explicitly notify you on this page.

Logo Display Policy

In order to use NOSTRA MAP on your application or any print media, you accept and agree to clearly display the copyright logo of NOSTRA which noticeably to the users that your application uses NOSTRA MAP SERVICE under the Terms of Services. Correspondingly, you agree to follow the conditions as shown below :

• You must download the following ZIP file which contains the NOSTRA logos in the correct sizes for web browser, Android and iOS applications.

• You agree not to resize, amend or modify these logos in any way.

• Logo must be displayed clearly in the appropriate size at the bottom left or right of the map screen in your application.

• You must create an image hyperlink on NOSTRA logo that link to NOSTRA website at www.nostramap.com/en/business/solution/map-online-services The following code is a sample of html syntax which use for creating image hyperlink.
